Occupational health, safety and welfare

The Occupational Health, Safety and Welfare Act 1986 (SA) states that an employer must provide a safe work environment and ensure as far reasonably practicable that the employee while at work is safe from injury or risk to health. As well as a safe working environment the employer must provide a safe system of work and keep plant and substances in a safe condition. The Act provides severe penalties for failure to do so. It also puts a duty on the employee to protect his or her own health, and any fellow worker's health and to ensure that safety is not endangered by the presence of alcohol or drugs. An employee is required to use safety equipment and to obey health and safety instructions. The Act also provides for the election by workers of their own safety representatives, who have various obligations and rights under the Act which must be respected by the employer. Safety representatives have the power to call in inspectors and to order workers to stop work in urgent circumstances, see accidents at work.
