INCORPORATION UNDER A SPECIFIC ACT

The South Australian Health Commission Act 1976 allows for hospitals and health centres providing health services to become incorporated. To be incorporated as a health centre it is not necessary to provide services to patients or clients on a 'live-in-basis'. Organisations in close contact with, and receiving significant funding from, the South Australian Health Commission may, with the approval of the Corporate Affairs Commission, become incorporated. Their management structures and the terms of their constitutions will be negotiated with the Health Commission or the Minister of Health and their boards of directors may include ministerial appointments. The Children's Services Act 1985 provides for the incorporation of children's services centres. These include kindergartens, preschools and licensed child care centres operating on a non-profit basis and assisted by public funding. Most children's service centres which to date have been incorporated under the Children's Services Act have been preschools in which the workers are direct employees of the Children's Services Office. The vast majority of child care centres are incorporated under the Associations Incorporation Act 1985 . Children's services which wish to be incorporated under the Children's Services Act rather than the Associations Incorporation Act should approach the Children's Services Office, Department of Education Training and Employment for more information.

The Local Government Act 1934 allows for incorporation of projects for facilities closely associated with councils. Where only one council is involved, the management body will operate as a committee of council and the organisation will form part of the corporate structure of council [s 199]. Where more than one council is involved, the organisation will be an independent body corporate [s 200].
