Bail pending appeal

There is no presumption in favour of bail where the defendant is lodging an appeal against conviction or sentence. The Court has unfettered discretion [see Bail Act 1985 (SA) s 10(2)]. In most cases the duty solicitor is not involved, because an instructed solicitor has conduct of the matter.
